Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the MedTrack iOS application (the "app") or visiting medtrackapp.com, you agree to these Terms of Service, our Privacy Policy, and Apple's App Store Terms of Service. If you do not agree, do not use the app.

2. Eligibility

• You must be at least 17 years old — matching the app's App Store age rating — or the age of majority in your jurisdiction, whichever is higher.
• If you are between 13 and the age of majority in your jurisdiction, you must have parental or guardian consent to use the app.
• You represent that all information you provide to us is accurate.

3. Account Registration

• One person, one account.
• You are responsible for maintaining the confidentiality of your sign-in credentials.
• Notify us at medtrackinfo@gmail.com of any unauthorized access to your account.
• You may request account deletion in-app at any time (Settings → Account & data requests → Request deletion). We respond within 7 days.

4. Subscription & Billing

• MedTrack Premium is offered as an auto-renewing subscription through Apple's In-App Purchase system.
• Subscription tiers and prices are displayed in-app at the time of purchase. Pricing may vary by region.
• A subscription automatically renews at the end of each billing period at the then-current price unless canceled at least 24 hours before the end of the period.
• Cancellation: manage and cancel your subscription through your Apple ID settings (Settings → [your name] → Subscriptions). Cancellation takes effect at the end of the current billing period.
• Payment is charged to your Apple ID account at confirmation of purchase and at each renewal.
• Free trial periods, when offered: any unused portion of a free trial is forfeited if you purchase a subscription before the trial ends.
• Apple's standard In-App Purchase terms govern the payment relationship. We do not store or process credit card information directly.

5. Practice Interview Credits

• Premium subscribers receive a defined number of Practice Interviews per month (currently 3, subject to change with notice).
• Unused monthly interviews do not roll over to the next month.
• Additional Practice Interview credits may be purchased as consumable in-app purchases. Purchased credits do not expire while your account is active but are forfeited on account deletion.

6. Refunds

All subscription and consumable purchases are processed by Apple and are subject to Apple's refund policies. We cannot process refunds directly. To request a refund, use Apple's refund process at reportaproblem.apple.com.

7. Acceptable Use

You agree NOT to:

• Use the app for any unlawful purpose
• Attempt to gain unauthorized access to other accounts or our systems
• Reverse engineer, decompile, or attempt to extract source code from the app
• Use automated scripts, bots, or scrapers
• Misrepresent your identity or impersonate others
• Upload content that is defamatory, harassing, threatening, or infringes others' rights
• Use the app to share or store materials related to academic dishonesty (for example, distributing actual MCAT test questions in violation of the test publisher's terms)

8. User Content

• You retain ownership of content you create in the app (MCAT scores, experience entries, school targets, notes, advisor messages).
• You grant MedTrack a limited license to store, process, and display your content as needed to operate the app.
• You are responsible for your content. We may remove content that violates these Terms.

9. AI-Generated Content & No Professional Advice

• The AI Advisor and Practice Interview features use third-party AI services to generate responses.
• AI outputs may contain inaccuracies, hallucinations, or outdated information. Do not rely on AI outputs as factual or authoritative.
• MedTrack is NOT a substitute for licensed medical school admissions counseling, academic advising, medical advice, or career counseling.
• Decisions about your medical school applications, career, or education should be made in consultation with qualified human professionals.

10. MCAT, AAMC & Trademark Disclaimer

• MCAT® is a registered trademark of the Association of American Medical Colleges (AAMC).
• MedTrack is not affiliated with, endorsed by, sponsored by, or in any way officially connected to the AAMC.
• MedTrack's projected MCAT score and study tracking features are independently developed and are not validated or endorsed by the AAMC.
• AMCAS® is a registered trademark of the AAMC. MedTrack uses AMCAS-style categorization for educational purposes only and is not an AMCAS application service.

11. Intellectual Property

• The MedTrack app, website, brand, logo, and all related materials are owned by MedTrack LLC.
• You may not copy, modify, distribute, sell, or lease any part of the app or its content without our written permission.
• This license to use the app is personal, non-exclusive, non-transferable, and revocable.

12. Third-Party Services

The app integrates third-party services (listed in our Privacy Policy). Use of those services may be subject to additional terms set by the providers. We are not responsible for third-party services' practices.

13. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS. PROJECTED MCAT SCORES AND OTHER COMPUTED METRICS ARE ESTIMATES BASED ON SELF-REPORTED PRACTICE DATA AND ARE NOT GUARANTEES OF ACTUAL EXAM PERFORMANCE.

14. Limitation of Liability

Legal review recommended — limitation of liability clauses vary by jurisdiction.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDTRACK LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages; these limitations may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless MedTrack LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the app, your violation of these Terms, or your violation of any third party's rights.

16. Termination

• We may suspend or terminate your account if you violate these Terms.
• You may terminate your account at any time by using the in-app delete account flow or emailing medtrackinfo@gmail.com.
• Provisions of these Terms that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) shall survive.

17. Governing Law & Dispute Resolution

Legal review strongly recommended — arbitration clauses are jurisdictionally sensitive.

• These Terms are governed by the laws of the State of Michigan, without regard to conflict of laws principles.
• Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except where prohibited by law.
• You waive any right to participate in class action lawsuits or class-wide arbitration.
• This arbitration clause does not apply to claims that may be brought in small claims court.

18. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notification or email. Continued use after changes constitutes acceptance.
